THIS IS A RENTAL AGREEMENT BETWEEN KITSAP LUXURY BATHROOMS LLC AND THE CUSTOMER AS SPECIFIED DURING CHECKOUT.

TERMS AND CONDITIONS OF RENTAL

By completing this booking, you confirm that you have read, understood, and agree to the terms and conditions outlined in this rental agreement.

CONTRACT

  1. There is a Non-Refundable damage waiver in the amount of $250.00 per trailer rental that limits Lessee liability for minimal damages such as scratches, scuffs, etc. The Damage Waiver also limits customer liability to damages up to $3,000 in the event of total damage or major repair while in Lessee’s possession due to fire, accidental damage, carelessness, vandalism, riot, or for missing unit due to theft with an appropriate police report. The damage waiver is non-refundable. Total replacement cost of restrooms ranges from a minimum of $30,000 for smaller models and reaches up to $100,000 for larger models. If damage occurs, the $250.00 fee is applied to the damage total with the limits as set forth above.

RESTROOM PLACEMENT AND SURFACE MATERIAL TERMS

By proceeding with the rental and completing your booking, you acknowledge and agree to the following terms regarding restroom placement and surface material:

During the delivery portion of your order, it is important to consider the placement of the restrooms and any sensitive ground materials our trucks and restrooms may need to traverse. Kitsap Luxury Bathrooms will make every effort to keep trucks and restrooms on paved surfaces. However, if our equipment needs to travel over non-paved surfaces, you are granting permission for Kitsap Luxury Bathrooms to do so and releasing Kitsap Luxury Bathrooms from any damage to manicured landscape, irrigation systems, septic fields, etc.

  • Paved Surfaces: We will aim to place the truck and restrooms on paved surfaces throughout the delivery and placement.
  • Non-Paved Surfaces: By completing your booking, you give Kitsap Luxury Bathrooms permission to travel across or place the truck and restroom on an unpaved surface, releasing Kitsap Luxury Bathrooms from any potential damage to property over unpaved surfaces.
    (NOTE: If trucks and restrooms will need to travel over manicured landscape, it is best to NOT WATER the grass for at least one week prior to delivery.)
  1. Total Bill Payable as Follows: (50%) non-refundable deposit due with signed agreement to secure date and reserve equipment. The balance is due upon delivery.
  2. By paying any portion of the above-listed bill, Lessee is hereby accepting the terms and conditions of this rental agreement.

Lessee agrees to return equipment listed on the front side of the contract in good condition and further agrees to assume full responsibility for any damages to, or loss of, said equipment and to pay full cost of repairs or replacement if lost or stolen. Lessee shall assume all liability and hold Lessor harmless for any damage or injury claims arising due to negligent use or care of equipment.

Additional Terms and Conditions:

  1. Lessee agrees to be responsible for rental/service charges of said unit(s).
  2. The 50% deposit is non-refundable once it is made.
  3. Lessee agrees to order sufficient service so as not to overtax the unit’s designed capacity.
  4. Lessee shall be responsible for the rental until the unit is picked up and removed from the rental property.
  5. Rental periods are charged for a minimum of 1 day unless otherwise stated.
  6. If street parking or permitted parking is required, it is the Lessee’s responsibility to gain permission. Any fines, fees, towing, etc., are the responsibility of the Lessee.
  7. Lessee agrees not to remove the rented property from the original delivery location without notifying Kitsap Luxury Bathrooms’ office.
  8. Units must be located such that service trucks can easily access the rental(s) for servicing at all times.
  9. If a contact person is not available on site for the pre-arranged delivery date and time, restrooms will not be released. A secondary delivery date and time will need to be arranged for an additional fee.
  10. All invoices are considered correct unless Lessor is notified within 7 days of the last invoice.
  11. Lessee releases Kitsap Luxury Bathrooms from liability due to accidents or other causes while the rental(s) are in their possession.
  12. Lessee will not alter or make attachments to the equipment.
  13. Lessee will notify Kitsap Luxury Bathrooms immediately and discontinue use of the equipment if it becomes unsafe or in disrepair.
  14. The customer is responsible for obtaining permission for the equipment site.
  15. Customer will not assign this agreement or transfer control of the equipment.
  16. Average setup time is 1 hour. Any delays caused by the customer will result in additional charges.
  17. Lessee is responsible for any damage to or loss of the equipment.
  18. Kitsap Luxury Bathrooms reserves the right to make equipment substitutions.
  19. If payments are not made, Kitsap Luxury Bathrooms can pursue remedies by law, including repossession.
  20. Kitsap Luxury Bathrooms is not liable for conditions beyond their control, including extreme temperatures or material shortages.

    Each of the following events may result in ADDITIONAL FEES if not arranged in advance.
    THESE ARE NOT CURRENTLY INCLUDED IN YOUR BILLING TOTAL.

    1. Delivery, pick-up, or service required outside the hours of 7:30 am – 5:30 pm: Fee determined by location and time required (TBD)
    2. If a driver is blocked from the property for more than 15 minutes: $50
    3. If a driver must wait more than 30 minutes and/or is turned away from a scheduled service, delivery, or pick-up due to site inaccessibility, a trip fee will be applied: $245 minimum
    4. No access to water on the property: $150
    5. If water is farther than 100 feet from restrooms, requiring additional hose during the event: $50
    6. No access to power on the property, requiring generator rental: $245 – $345
    7. If power is farther than 100 feet from restrooms, requiring additional electrical cord: $50
    8. If power cords need to be protected with plate covers due to driveway or walkway: $50
    9. Additional Tank Servicing Outside Discussed Schedule: Fee determined by restroom size and event location (TBD)
    10. Excessive Cleaning Fee: Fee based on a per-hour charge for additional cleaning: $95
    11. If a unit needs to be moved AFTER placement is approved and removed from the truck: $95
    12. Site Failure Resulting in Service Call (e.g., water shut-off, cord unplugged, site power outage): Fee determined by location and time of service call (TBD)
    13. If water/power is disconnected prior to the service and pick-up of the restrooms and debris is left in the toilet basins: $195
    14. Overuse of the holding tank: Fee based on excessive cleaning charge combined with damage and repairs required (TBD).

    MAY WE TAKE A PRETTY PHOTO OF OUR RESTROOMS SET UP AT YOUR EVENT?

    Note: This photo release allows us to take a “pretty photo” of the restrooms. This DOES NOT allow us to include faces, addresses, names, or identifying landmarks.
    Your Privacy is our priority!

    For valuable consideration, the undersigned hereby grants the legal rights to permit Kitsap Luxury Bathrooms commercial use of photographs of the property. I hereby release Kitsap Luxury Bathrooms, acting with their permission, from any claims regarding the use of the photos.

    If you prefer to opt-out of allowing Kitsap Luxury Bathrooms to use photos from your event for marketing purposes, you must notify us in writing. Otherwise, we will assume consent by default.
